Subpoenas Raise Uncomfortable Questions

Subpoenaing information from lawmakers and
reporters is highly unusual and should have been
subject to strict scrutiny by top department offi-
cials, legal experts said. The subjects involved raised
fraught questions about the First Amendment,
separation of powers and the role of politics in the
department’s investigations. But whether changes
will come to the subpoena process is another ques-
tion that will largely depend on the findings of
investigators.
The Justice Department’s Office of Inspector Gen-
eral said it would investigate the department’s use of
subpoenas for members of Congress and the media,
and Democrats in Congress have also announced
their own probes.
