District Court
MEMORANDA AND ORDERS
DECEMBER 12, 2024
BY BARTLE, J.
USA v. Brown; 04-0532; Accordingly,
his motion for reduction in sentence will be denied.
BY LEESON, JR, J.
Watson v. Wetzel et al; 23-3246; For
the reasons outlined above, Defendants are entitled to summary judgment on each
of Watsons claims.
BY ALEJANDRO, J.
Bey v. Amoroso et al; 24-1786;
For the foregoing reasons, the Court will dismiss, with prejudice, Beys Fifth and Sixth Amendment claims, and his claim
against Defendant Carney based on his testimony at the preliminary hearing because
they are not plausible, and amendment would be futile.
BY MURPHY, J.
Baucom et al v. Torres Vidal;
24-1818; For the foregoing reasons, we hold that removal was proper under 28
U.S.C. 1446(b)(3) and therefore deny the Baucoms motion to remand (DI 4).
BY LEESON, JR, J.
Virgo v. Virgo; 24-5722; Accordingly,
the Amended Complaint will be dismissed without prejudice for lack of subject
matter jurisdiction.
DECEMBER 13, 2024
BY SCHMEHL, J.
Wiker v. Lancaster General
Health et al; 24-2592; For the foregoing reasons, the
Defendants motion to dismiss Counts I-IV of the First Amended Complaint is
granted. Count V, asserting claims for retaliation, shall remain.
BY SCHMEHL, J.
Bush v. The City of Allentown Police Department; 24-6337;
For the foregoing reasons, the Court will grant Bush
leave to proceed in forma pauperis and dismiss his
Complaint.
BY GALLAGHER, J.
Tierney et al v. United States of America; 24-4400; For the foregoing reasons, Defendants Motion to Dismiss is
granted. Plaintiffs Complaint is dismissed with prejudice for lack of subject
matter jurisdiction.
