District Court

MEMORANDA AND ORDERS

DECEMBER 14, 2022

BY BARTLE, J.

Elmegreen v. Merck & Co., Inc. et al; 17-2044;

Accordingly, the court will tax costs in favor of Merck in the amount of

$13,627.36.

In Re: Zostavax (Zoster Vaccine Live) Products

Liability Litigation; 18-2848; The court reduces the costs taxed to

plaintiff by $73.20, which is one-fifth of the total transcript

acquisition cost for that hearing.

BY GOLDBERG, J.

Berg v. Delaware County Probation Department; 19-

1275; For the reasons set out above, I will deny Bergs petition for a

writ of habeas corpus.

BY SANCHEZ, J.

Road-Con, Inc. et al v. The City of Philadelphia

et al; 19-1667; The Court will reserve ruling on the Equal Protection

claim.

BY SMITH, J.

Royster v. Mahally et al; 19-2126; For the reasons

discussed above, the court agrees with Judge Rice that Royster did not

show that he was entitled to the alternative start date in section

2244(d)(1)(D).

Clark v. Alight Solutions, LLC; 21-1855;

Accordingly, the instant motions seeking entry of a default judgment

against the defendants are denied.

BY ROBRENO, J.

Johnson v. Mold Solutions & Inspections, LLC; 21-

2589; Defendants motion for fees is denied as it was not the prevailing

party.

BY BAYLSON, J.

Mutual Securities, Inc. et al v. Gilotti et al;

21-5031; Mutual argues that it did not have to seek expungement from the

Panel, and that it was only seeking fees and costs for a separate

expungement proceeding before an appropriate court.

BY PRATTER, J.

Swainson v. City of Philadelphia et al; 22-2163;

For these reasons, the Court denies Mr. Santiagos motion to stay without

prejudice.

BY KEARNEY, J.

Swainson v. City of Philadelphia et al; 22-3257;

We affirm Judge Chans denial of Ms. Busbys contempt motion.

BY LEESON, JR, J.

USA v. King; 22-0215; . For those reasons, and for

those given above, Kings Motion is denied.
