MEMORANDA AND ORDERS

DECEMBER 23, 2020

BY WOLSON, J.

Foundation For Eldercare v. Money One Federal Credit; 18-5059; For now, the Court will grant the Foundations partial summary judgment motion, and it will grant Money Ones motion in part.

BY SURRICK, J.

USA v. Fields; 06-0155; For these reasons, Fieldss request for a compassionate release is denied.

BY ROBRENO, J.

R.B., et al v. Downingtown Area School District; 19-4035; For all of the aforementioned reasons, both motions for judgment on the administrative record will be denied.

BY MARSTON, J.

LM General Ins. Co. v. Lebrun, et al.; 19-2144; For the foregoing reasons, we deny the LeBruns motion for reconsideration.

Nadzam v. Broan-Nutone, LLC; 20-6088; Thus, we find that it is in the interest of justice to transfer the case to the Western District of Pennsylvania.

BY LEESON, JR, J.

Cunningham v. Albright College, et al.; 20-1429; Cunningham is granted leave to amend his Complaint as to only those claims dismissed without prejudice.

BY KEARNEY, J.

Heyward v. City of Philadelphia, et al.; 20-0530; The City and its officers move to dismiss arguing Mr. Heyward fails to state a cognizable procedural due process claim, the individual officers are entitled to qualified immunity, and he fails to state a claim for municipal liability against the City.

BY GALLAGHER, J.

Fischer v. Federal Express Corp., et al.; 19-4924; Plaintiffs have made a modest factual showing that they and other putative class members are similarly situated.

BY BARTLE, J.

USA v. Wilson; 19-0122; Accordingly, the Court will deny the motion of defendant for a reduction of sentence.
