District Court
MEMORANDA AND ORDERS
NOVEMBER 18, 2024
BY YOUNGE, J.
Liz v. Pennsylvania Department of Corrections et al;
22-396; The motion to dismiss filed by Defendant Anthony Letizio,
DO, as it relates to Section 1983 claims for deliberate indifference will be
denied. The motion to dismiss filed by Defendants Mark Kopcik,
Patrick Curley, and Steven Merrideth will be denied.
BY HEY, J.
F.H. v. OMalley; 23-261; The ALJs decision is not
supported by substantial evidence. The ALJ failed to consider a medical opinion
from a medical source and erroneously assessed the medical opinion evidence.
BY PEREZ, J.
USA v. Easley; 24-152; For the foregoing reasons, the
Court concludes that the indictment, and the prohibition of drug traffickers
and other dangerous felons from possessing firearms, does not violate Mr.
Easleys Second Amendment rights. Accordingly, Mr. Easleys motion to dismiss
the indictment will be denied.
BY MARSTON, J.
Mazzoni Center et al v. LCF
Group, Inc. et al; 24-5921; Because Plaintiffs have failed to show that they
are likely to succeed on any of their claims against Defendants, the motion for
temporary restraining order and preliminary injunction is denied. The Court
need not reach the remaining preliminary injunction factors.
