District Court

MEMORANDA AND ORDERS

NOVEMBER 14, 2024

BY KEARNEY, J.

USA v. Wilson et al; 14-209; Mr. Wilson does not present an extraordinary and compelling reason for his release. Absent this threshold finding we do not need to analyze whether early release would be consistent with Congresss section 3553(a) factors. We deny Mr. Wilsons Motion for compassionate release without prejudice.

BY PEREZ, J.

USA v. Rodriguez; 23-250; For all the aforementioned reasons, the Court concludes that the indictment, and the prohibition of drug traffickers and other dangerous felons from possessing firearms, does not violate Mr. Rodriguezs Second Amendment rights.

BY WOLSON, J.

Dicasimirro v. Getmyboat, Inc. et al; 24-5851; That GMB might have a defense under federal law is insufficient to confer jurisdiction, and that has been the law for many, many (many) years. Thus, I will remand this matter back to state court.

BY LEESON, JR., J.

Virgo v. Virgo; 24-5722; Accordingly, the Complaint will be dismissed without prejudice for lack of subject matter jurisdiction. The Court will permit Virgo an opportunity to file an amended complaint to explain the nature of the claim more fully and how this Court can exercise subject matter jurisdiction.

BY LEESON, JR., J.

Jaskulis et al v. State Farm Fire and Casualty Company; 24-4286; For the reasons outlined above, the Court dismisses Counts I and II without prejudice.

BY BEETLESTONE, J.

Mehdizadeh v. Starbucks Corporation d/b/a Starbucks Coffee Company; 24-3339; For the foregoing reasons, Starbucks Motion is granted and Mehdizadehs Motion is denied.

BY COSTELLO, J.

Wilkerson v. Clark et al; 24-5958; For the reasons stated, the Court will dismiss Wilkersons Complaint. Because an attempt to amend these claims would prove futile, the dismissal will be with prejudice.

BY SURRICK, J.

Yarmey v. University of Pennsylvania; 20-5535; For the foregoing reasons, Penns motion for summary judgment will be granted in its entirety
