MEMORANDA AND ORDERS

NOVEMBER 13, 2024

BY GOLDBERG, J.

Inman-Clark v. The Neiman Marcus Group LLC et al; 19-4717; Factual issues remain as to the extent of the injuries attributable to the incident in question, but liability on the part of Neiman Marcus has been established as a matter of law and Plaintiff is entitled to the entry of summary judgment in her favor on liability.

BY KENNEY, J.

USA v. Weatherbe; 21-052; Mr. Weatherbe has not presented extraordinary and compelling reasons to reduce his sentence under compassionate release, as required by 3582(c)(1)(A). The Court therefore denies Mr. Weatherbes Motion for Reduction in Sentence.

BY WOLSON, J.

Trecom Systems Group, Inc. v. MJ Freeway, LLC et al.; 21-1575; I will grant MJFs motion concerning the introduction of race and references to TreCom as a Black-owned business. I will deny MJFs other motions and deal with issues if and when they arise at trial.

BY WOLSON, J.

Ruell v. McDonough; 23-3513; In addition, Ms. Ruell cannot proceed with claims under the Inspector General Act and the VBHCITA because neither statute authorizes an express or implied private cause of action. Finally, because all her claims fail for one reason or another, Ms. Ruell is not entitled to declaratory relief.

BY MURPHY, J.

Rivera v. Commonwealth of Pennsylvania Office of the Attorney General; 23-454; Ms. Riveras latefiled declaration in support of her opposition to summary judgment, even when taken as true, does not raise any genuine disputes of material fact as to either of these claims.

BY MURPHY, J.

Chijioke-Uche v. Sherwood Crossing Apartments Homes et al; 24-047; For the foregoing reasons, we grant defendants motion to dismiss pursuant to Rule 12(b)(6). Dr. Chijioke-Uches FCRA claims against Sherwood Crossing and National Credit Systems are dismissed without prejudice and with leave to amend.

BY MURPHY, J.

Santoro et al v. Tower Health et al; 22-4580; For the foregoing reasons, we deny plaintiffs motion for reconsideration. We also deny their request to file the proposed TAC.

BY GALLAGHER, J.

Marchese v. 21st Century Cyber Charter School et al; 24-2114; For the foregoing reasons, Count IV of Plaintiffs Complaint (ECF No. 1) is DISMISSED WITHOUT PREJUDICE.

BY LEESON, JR., J.
