District Court
MEMORANDA AND ORDERS
OCTOBER 30, 2024
BY KEARNEY, J.
Byrd v. Commissioner of Social Security; 23-4957; We deny Ms. Byrds request for review. Judge Silverman did
not improperly rely on his own lay opinion in treating the various medical
opinions and he did not commit reversible error with his reference to fibro
fog.
BY KEARNEY, J.
Justman v. Prudential Insurance
Company of America, et al; 24-4107; We grant Accentures motion to dismiss
without prejudice to Mr. Justman timely amending to
plead facts allowing us to plausibly infer a claim within our limited
jurisdiction against his wifes former employer.
BY SCHMEHL, J.
Davis v. The City of Philadelphia et al; 24-1563; For the
foregoing reasons, the Court will grant the Defendants Motion to Dismiss
Daviss First Amendment claim against them. There is no basis for further
amendment here.
BY PADOVA, J.
Doe v. Lacolmb et al; 24-1843; For the foregoing reasons, the Court will grant Doe leave to
proceed in forma pauperis, and dismiss his Complaint
without prejudice. Doe will be given an opportunity to file an amended
complaint in the event he can plead additional facts to cure the defects the
Court has noted as to his claims.
BY MCHUGH, J.
Lewis v. Brantley et al; 24-2673; For the foregoing
reasons, the Court will dismiss Mr. Lewiss Amended Complaint without prejudice
pursuant to 28 U.S.C. 1915(e)(2)(B)(ii) for failure to state a claim.
