District Court
MEMORANDA AND ORDERS
APRIL 22, 2024
BY SANCHEZ, J.
Elliott v. Folino et al;
13-1944; Elliotts second objection regarding his counsels failure to inform
him a first degree murder conviction could result in a sentence of life without
parole is also meritless.
Pomper v. AAA Mid-Atlantic
Insurance Group; 23-3757; Federal Rule of Civil Procedure 15(a) requires the
Court to freely give leave to amend when justice so requires. Because it is
possible Pomper could plead additional facts to
support a claim of bad faith, Count II will be dismissed without prejudice.
BY PAPPERT, J.
Davis v. Huntingdon State Prison; 19-3733; Reasonable
jurists would not debate this Courts ruling, and Davis has not made a
substantial showing of a denial of a constitutional right as required by
Section 2253(c)(2).
BY KEARNEY, J.
USA v. Leslie; 22-0391; Mr. Leslies earlier convictions
for robbery and aggravated assault place him firmly in the category of those
who have been disarmed consistent with our Nations historical tradition.
BY BARTLE, J.
USA v. McLemore; 23-0393; The
motion of Mclemore to suppress the evidence obtained
from the search of his cell phone on November 9, 2021 will be denied.
